1. General terms and definitions
1.1. Terms – The terms of use for services provided in JSC “Kauno stadionas” Tennis Courts that define provision of services in the Tennis Courts, mandatory safety, hygiene, and other requirements for Clients (defined below), the rights, responsibilities and obligations for Tennis Courts and its Clients. The Terms have the validity of service agreement between a Client and JSC “Kauno stadionas.” The terms are provided on the internet website https://zalgiris.koobin.com/more-products?act=1 . In case of a market or market regulatory act changes, or on other basis and under different circumstances, JSC “Kauno stadionas” has the right to update the Terms by informing Clients 10 days before the update on the https://zalgiris.koobin.com/more-products?act=1 website.
1.2. Tennis Courts – The Tennis Courts at Perkūno avenue, Kaunas, managed by JSC “Kauno stadionas”.
1.3. Services – The Services provided by JSC “Kauno stadionas” that include rent of tennis courts, tennis trainings, competition organization, and other Services.
1.4. Service package – The respective amount of JSC “Kauno stadionas” services per respective period that for each case is defined on the internet website https://zalgiris.koobin.com/more-products?act=1 .
1.5. Client – A person, who acquired a ticket, a subscription, a gift coupon according to the procedure set by the Operator, or entered the Tennis Courts by other legal means set by the Operator. The terms of ticket and subscriptions sales, exchanges and returns are defined by these Terms (further defined as Terms).
1.6. Client’s playing partner – A person who is using JSC “Kauno stadionas” services at the same time with a Client, or whose usage of JSC “Kauno stadionas” services on a different time than the Client is paid by the Client. Clients’ playing partners must comply with all terms provided in these Terms, except with those that are applied to Clients only.
1.7. Reservation – The advance booking of tennis courts or other services provided by JSC “Kauno stadionas”.
1.8. Contract – The service contract between a Client and JSC “Kauno stadionas” according to the policy set by these Terms. If parties don’t sign a separate written contract, these Terms aret reated as the contract. Contract conditions not covered by these Terms (service fee and others) are published on the JSC “Kauno stadionas” website https://zalgiris.koobin.com/more-products?act=1 and are an integral part of the contract.
1.9. Contract parties – A Client and JSC “Kauno stadionas”, company code 302505310, address Karaliaus Mindaugo pr.50, Kaunas, represented by the managing director Saulius Balnanosis.
2. The right to use services provided by JSC “Kauno stadionas”
2.1. Clients who purchased a Service Package or one-time visit Services according to set policies, and have signed the acknowledgement to the Terms have the right to use JSC “Kauno stadionas” services.
2.2. Client’s playing partners have the right to use JSC “Kauno stadionas” services.
2.3. Individuals participating in organized competitions according to specific competition policies have the right to use JSC “Kauno stadionas” services.
3. Acquisition and usage policy for JSC “Kauno stadionas” Tennis Service/Service Packages
3.1. Amount, frequency, and descriptions of tennis Services provided by JSC “Kauno stadionas”, validity and Service offering periods, Service prices, and other essential conditions are indicated on the website: https://zalgiris.koobin.com/more-products?act=1.
3.2. JSC “Kauno stadionas” tennis services are offered only to Clients who paid in advance. As these Terms are considered to be the service provision agreement between JSC “Kauno stadionas” and the Client, the agreement becomes valid the moment a payment for the Services is made, except when JSC “Kauno stadionas” and the Client signs a different agreement.
3.3. Clients can purchase JSC “Kauno stadionas” Tennis Service Packages or one-time visit Services by paying for them in advance on the website https://zalgiris.koobin.com/more-products?act=1 according to the policies indicated on the website.
3.4. The Client who acquired the right to use JSC “Kauno stadionas” Tennis Services is provided with an electronic confirmation indicating the type of a specific Service, the amount (in units/times/hours) of Services included in a Service Package and/or validity periods of Service provision and other essential conditions.
3.5. Clients who want to use discounts applied for the “Students” group must provide the document confirming they have the right to this discount.
3.6. The validity and provision periods for Services and/or Service Packages are not extended, except for cases when the Client is unable to use the Services they’re paid for due to an illness and has immediately informed and provided the documents confirming the case. In this case, the validity and provision periods for Services and/or Service Packages are extended for the sick leave period and/or for the period indicated in a doctor’s note. The document confirming the illness must be provided no later than 1 month after the end of illness date indicated in the document.
3.7. If not stated otherwise, the right to use JSC “Kauno stadionas” services according to a respective Service Package is granted to the Client personally, therefore, the respective rights cannot be transferred (gifted, sold, exchanged, etc.) to other individuals without an advance agreement of JSC “Kauno stadionas”.
3.8. If a Service/Service Package is acquired by a legal person, they must designate a dedicated representative responsible for Service reservations and communication. JSC “Kauno stadionas” has the right to demand for the respective legal person to indicate a specific natural person who has the right to use the acquired Services/Service Packages under the name of the legal person.
4. Spot reservation
4.1. To use Services, the Client must reserve a spot in advance on this website: https://savitarna.stadionas.lt/.
4.2. If the Client cannot come to play on a reserved time, they must cancel the reservation or transfer the right to use Services for Client’s Playing Partners at their own cost. Canceling a reservation is possible no later than 48 hours before the start of activity, unless JSC “Kauno stadionas” allows the cancellation of a reservation later.
4.3. It is considered that a Client who reserved a spot has visited the Tennis Courts at JSC “Kauno stadionas” and used the Service. For this reason, payments for reserved but unused Services are non-refundable, with the only exceptions determined in Terms.
4.4. JSC “Kauno stadionas” is not responsible for timetable changes and cannot guarantee the accuracy and consistency in timetables. JSC “Kauno stadionas” is not responsible for losses or damage caused by timetable inaccuracy.
5. Storage of items
5.1. JSC “Kauno stadionas” does not offer protected storage for items, but provides Clients with an option to store items in designated places.
5.2. It is recommended for Clients not to bring expensive and valuable items to JSC “Kauno stadionas” Tennis Courts.
5.3. Clients leave their personal items in lockers located in changing rooms. Clients must lock the lockers after placing their items.
5.4. The Client must immediately inform a JSC “Kauno stadionas” employee about damaged or missing items.
5.5. JSC “Kauno stadionas” is not responsible for damaged and/or missing items of Clients.
5.6. Lost and found items are stored at JSC “Kauno stadionas” for up to 14 days, and then discarded.
5.7. When leaving the premises managed by JSC “Kauno stadionas”, the Client must leave the locker unlocked. If there are locked lockers at the end of working hours ,JSC “Kauno stadionas” employees have the right to unlock the lockers and remove the items.
6. Rules of conduct
6.1. All JSC “Kauno stadionas” Clients and/or related individuals must behave properly and adhere to the Terms, as well as generally accepted behavior norms of tennis court visitors.
6.2. Before starting a game, the Client must ensure that all other players and visitors are at a safe distance and will not be hit by a flying tennis ball, with a racket, or there will be no harm made to them in any other way.
6.3. Mobile phone sounds must be switched off in the tennis courts.
6.4. In the tennis courts Clients must:
6.4.1. Follow instructors’/trainers’ instructions for the course, order, and rest in an activity/training. During group activities, the Client does not have to do all exercises given by an instructor. If the Client is unable to do group exercises, they must not disturb other Clients.
6.4.2. Before using any equipment, familiarize themselves with the usage Terms displayed on the equipment itself or posted in JSC “Kauno stadionas” premises. In case of any doubts, Clients must not use the equipment, and consult responsible JSC “Kauno stadionas” employees regarding the information needed instead.
6.4.3. Wear specialized sports clothing and footwear needed for the specific surface of the Tennis Court.
6.4.4. After using the equipment, leave it orderly and available for other Clients to use.
6.5. In the Tennis Courts it’s prohibited to:
6.5.1. Shout, whistle, curse, smoke, consume alcoholic beverages, litter, smash rackets and other solid items into flooring, walls, partitions; damage equipment in any other ways; disturb other players/visitors.
6.5.2. Walk into the court of other players while a game is on.
6.5.3. Use equipment not according to instructions.
6.5.4. Without a JSC “Kauno stadionas” written permission, offer wellness or similar services, consult, train, or disturb JSC “Kauno stadionas” Clients and/or employees in any other way.
6.5.5. Photograph and film without a JSC “Kauno stadionas” written permission.
6.5.6. Bring food and/or consume alcoholic beverages in the JSC “Kauno stadionas” premises, except for water and/or other non-alcoholic beverages and/or special sports food. In the tennis courts and other premises managed by JSC “Kauno stadionas” with carpet or any other flooring that can be easily stained, it’s allowed to consume only water and/or other clear non-alcoholic beverages that do not leave stains when spilled.
7. Duties and responsibilities of JSC “Kauno stadionas”:
7.1. JSC “Kauno stadionas” has the right to change working hours, as well as change working hours for specific zones and regulate the possibility for Clients to enter them.
7.2. During maintenance, do not offer Services without informing Clients in advance on the website https://zalgiris.koobin.com/more-products?act=1.
7.3. Set different Terms and conditions (exceptions to these Terms) for separate Services offered during JSC “Kauno stadionas” promotions, to which Clients who purchased those Services must adhere to. The Terms and conditions exclusive to JSC “Kauno stadionas” Services offered during promotions are announced in promotion terms and on the JSC “Kauno stadionas” website https://zalgiris.koobin.com/more-products?act=1.
7.4. Create and change timetables for group activities at its own discretion.
7.5. In case of any doubts about the Client's health state, ask the Client to terminate a game/training/activity and provide a doctor’s note about their health status on a next visit.
7.6. Do not provide Services for individuals with health disorders, which can put the individual’s or other Clients’ health and/or life and safety at risk.
7.7. Ask Clients who have broken the Terms to terminate the usage of Service and leave premises managed by JSC “Kauno stadionas”. Money paid for a terminated visit is not refunded.
7.8. Inform Client about changes to working hours and activity timetables in advance by announcing the information on the website.
7.9. Stop and renew offering the Services for Clients if the tennis courts were closed because of reasons not related to the Client, except for national holiday days and preventive inspection works at JSC “Kauno stadionas”.
7.10. JSC “Kauno stadionas” creates a possibility to use their provided Services, but does not evaluate the influence of these Services on a specific Client’s health, as well as does not guarantee their positive effects.
7.11. JSC “Kauno stadionas” does not provide the Client with a compensation for pecuniary and non-pecuniary damages to Client’s health and life caused by Services offered. The Client confirms that they are properly informed, know and acknowledge that JSC “Kauno stadionas” and its employees are not held responsible for the Client when the Client themselves do not follow common safety requirements and/or instructions and/or Terms given by JSC “Kauno stadionas”.
7.12. JSC “Kauno stadionas” does not provide the Client with compensation for any inconvenience caused by discrepancies between the timetable and real life situation.
8. Client right, duties, and responsibilities
8.1. Wear neat and appropriate footwear and clothing.
8.2. While being in the territory of JSC “Kauno stadionas”, adhere to these Terms:
8.2.1. Be sober and not intoxicated with psychoactive substances (drugs, pharmaceuticals, alcohol, other intoxicating drinks and substances).
8.2.2. Carefully and responsibly use the property, inventory, and Services provided by JSC “Kauno stadionas”.
8.2.3. Use equipment and inventory of JSC “Kauno stadionas” only according to its purpose, in the ways and order determined in the equipment and inventory usage Terms, and following JSC “Kauno stadionas” employees recommendations and instructions.
8.2.4. Do not use equipment and inventory that is out of order. Inform responsible JSC “Kauno stadionas” employees about broken equipment. Reach out to JSC “Kauno stadionas” employees in case of any questions about the eligibility of equipment and inventory conditions.
8.2.5. Follow the instructions given by an instructor/trainer during group activities.
8.2.6. While using Services, put in all possible efforts and measures to avoid harming themselves, health, and property of other Clients and employees, and the environment managed by JSC “Kauno stadionas”.
8.2.7. Do not disturb other Clients while they’re using Arena’s Services. Immediately report inappropriate and threatening behavior towards other Clients’ safety and health to a responsible JSC “Kauno stadionas” employee , or call +370 682 33244.
8.2.8. In case of an accident, immediately contact employees of JSC “Kauno stadionas” or call +370 69813985 to inform them about a health disorder or trauma experienced while using Services provided by JSC “Kauno stadionas”.
8.2.9. Enter only JSC “Kauno stadionas” premises dedicated for Clients.
8.2.10. When leaving the premises, the Client must return all issued items to JSC “Kauno stadionas” employees. If the Client loses or breaks any of the items issued to them, the Client must fully compensate for the losses of JSC “Kauno stadionas”.
9. Client responsibility
9.1. A Client, before purchasing JSC “Kauno stadionas” services, must consider their health status and possible Service effect on them, i.e the Client must make sure that their health allows them to use Services provided by JSC “Kauno stadionas”.
9.2. When using services and equipment of the sports club, Clients must independently choose a physical load according to their individual needs, personal qualities, and influence on their bodies.
9.3. By purchasing a Service, a Client confirms that their health status is appropriate for using Services provided by JSC “Kauno stadionas”, understands that the usage of Services is related to big physical challenges, confirms that they have tested their health, and adheres to health testing requirements defined by legal acts of the Republic of Lithuania. In case suspicion for an inappropriate health state arises for the Client themselves or employees of JSC “Kauno stadionas”, the Client must terminate the game/activity/training.
9.4. The Client understands and confirms that JSC “Kauno stadionas” is not responsible for harm made to Client’s health and life. The Client takes the full risk and responsibility for health disorders, traumas, and accidents, including death, that happen both during and in consequence of Service provision.
9.5. The Client must compensate for damage made to JSC “Kauno stadionas” because of the Client’s fault according to a set loss evaluation act. If the Client doesn’t agree with the loss evaluation act provided to them, they can submit their reasonable objections in writing in 3 working days since receiving the act. In this case, scope of damage will be determined by both parties' agreement or by a decision by competent government authorities.
9.6. The Client must compensate for damage made to JSC “Kauno stadionas” no later than in 5 (five) working days since the day of receiving the loss evaluation act.
10. Conditions of service provision to underage Clients:
10.1. Parents (caregivers) are fully responsible for underage Clients under 16 years.
10.2. Underage Clients under 16 years and their groups must be accompanied and supervised by adults at all times, except during organized group activities and training.
10.3. Underage Clients between 16 and 18 years can visit independently, but they must have a written agreement from their parents/caregivers. A written agreement from parents/caregivers is valid until a child turns 18.
10.4. Adults supervising underage Clients must adhere to the provisions set in Terms. Adults supervising underage Clients must read, acknowledge, and comply with the rules set in Terms. Adults supervising underage Clients must supervise them at all times and take full responsibility for their safety.
11. Final clauses
11.1. By signing these Terms, Client approves with its signature that they have read the Terms, agrees to comply with them, and takes responsibility for any nonconformity to conditions defined in Terms and its consequences.
11.2. By signing these Terms, parents (caregivers) of underage Clients confirm that:
11.2.1. Health state of an underage Client allows them to use services provided by JSC “Kauno stadionas”.
11.2.2. An underage Client has read and acknowledged the Terms and will comply with them.
11.2.3. Damage made to JSC “Kauno stadionas” or third parties that is caused by an underage Client will be compensated according to legal acts of the Republic of Lithuania.
11.2.4. Parents (caregivers) take full responsibility for an underage Client’s behavior during a visit, any health disorder, or a case of death that happens because of poor or inappropriate supervision or any other dereliction of parents/caregivers duties.
11.3. Client agrees that JSC “Kauno stadionas” can transfer their rights and duties arising from relationships with Clients to third parties without a separate Client agreement in advance.
